Welcome to EmployNursing.com. These Terms of Service govern your access to and use of EmployNursing.com, including all job listings, employer services, candidate profiles, content, and related features available through the platform.
By accessing or using EmployNursing.com, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the platform.
EmployNursing.com is operated by Employ Nursing. If you access or use EmployNursing.com on behalf of a company, healthcare organization, staffing agency, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, and your use of the platform will be deemed acceptance of these Terms on behalf of that entity.
You may use EmployNursing.com if you are at least 18 years old and capable of entering into a legally binding agreement. By accessing or using the platform, you represent and warrant that you meet these requirements.
EmployNursing.com provides a professional marketplace that connects nursing professionals with employers, healthcare organizations, hospitals, clinics, long-term care facilities, staffing agencies, and other healthcare providers.

We reserve the right to suspend or terminate access to EmployNursing.com if we reasonably believe a user has provided false information, violated these Terms, engaged in fraudulent activity, or used the platform in a manner that may harm other users or the integrity of the marketplace.
Job seekers may create a profile, upload resumes and supporting documents and apply for positions listed on EmployNursing.com.
By using the platform, you agree to:
EmployNursing.com does not guarantee employment, interviews, job offers or hiring outcomes
When you apply for a job through EmployNursing.com, the information you submit, including your name, contact information, resume, credentials, and any supporting materials, may be shared with the employer, healthcare organization, staffing agency, or recruiter associated with the job posting.
By submitting an application, you authorize EmployNursing.com to transmit your application materials to the applicable employer or recruiter for the purpose of evaluating your candidacy and considering you for employment opportunities.
EmployNursing.com connects job seekers with employers, healthcare organizations, and recruiters. We do not guarantee interviews, job offers, employment, or any specific hiring outcome. All hiring decisions are made solely by the employer or recruiter.
If you post job listings on EmployNursing.com, you agree that all listings must:
EmployNursing.com reserves the right to review, remove, or restrict access to any job listing that we reasonably believe violates these Terms or may harm users or the integrity of the platform.
When job seekers apply to job listings posted on EmployNursing.com, the employer or recruiter posting the listing is responsible for handling applicant data in accordance with applicable data protection laws.

EmployNursing.com acts as a platform facilitator and is not responsible for how employers or recruiters handle applicant data after it has been shared through the platform.
You are solely responsible for ensuring that your job listings, recruitment activities, and hiring practices comply with all applicable employment, labor, equal opportunity, and anti-discrimination laws and regulations in your jurisdiction.
Employers and recruiters agree that they will not use EmployNursing.com to post or promote any job listings or recruitment practices that are unlawful, discriminatory, misleading, or otherwise non-compliant with applicable laws.
EmployNursing.com acts solely as a platform and does not provide legal advice or assume responsibility for employer compliance with employment laws.
You must not use EmployNursing.com to engage in any of the following activities:
EmployNursing.com reserves the right, at its sole discretion, to remove any content that violates these Terms and to suspend or terminate any account involved in prohibited conduct, without prior notice where necessary to protect the platform or its users.
EmployNursing.com may review, monitor, or evaluate content posted on the platform to help ensure compliance with these Terms and applicable laws. However, we do not have an obligation to proactively review all content.

You retain ownership of all content you submit, upload, or provide through EmployNursing.com, including job listings, profile information, resumes, applications, and any other materials (“Your Content”).
By submitting Your Content to EmployNursing.com, you grant Employ Nursing a worldwide, non-exclusive, royalty-free, transferable license to host, store, reproduce, display, and use Your Content solely for the purpose of operating, improving, and providing the services of the platform.
You represent and warrant that:
EmployNursing.com does not claim ownership of Your Content, and you remain responsible for the accuracy and legality of all content you provide.
Your use of EmployNursing.com is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, store, and protect personal data.
EmployNursing.com is built on third-party job board infrastructure provided by Job Boardly. Certain personal data submitted through the platform may be processed by Job Boardly on behalf of Employ Nursing solely for the purpose of providing hosting, infrastructure, and platform functionality.
Where applicable, users located in the European Economic Area (EEA) or the United Kingdom (UK) may have additional rights under the General Data Protection Regulation (GDPR) and UK GDPR. These rights are described in our Privacy Policy.
EmployNursing.com remains responsible for ensuring that personal data is handled in accordance with applicable data protection laws.
All intellectual property rights in the EmployNursing.com platform, including but not limited to its software, design, user interface, branding, content, and underlying systems, are owned by Employ Nursing or its licensors, including Job Boardly (operated by Glacier Systems Pty Ltd), where applicable.
These rights are protected by applicable intellectual property laws and international treaties.
You must not copy, modify, reproduce, distribute, sell, lease, or create derivative works based on EmployNursing.com or any part of the platform without our prior written consent.
Nothing in these Terms grants you any rights to use EmployNursing.com branding, trademarks, logos, or proprietary materials except as necessary to use the platform in accordance with these Terms.
EmployNursing.com is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law:
Use of EmployNursing.com is at your own risk.
To the maximum extent permitted by applicable law, EmployNursing.com and Employ Nursing shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or relating to your use of or inability to use the platform.
To the maximum extent permitted by law, the total liability of EmployNursing.com and Employ Nursing for any claim arising out of or relating to these Terms or the use of the platform shall not exceed the greater of:
(a) the total amount paid by you to EmployNursing.com in the 12 months preceding the event giving rise to the claim; or
(b) USD $100.
Nothing in these Terms excludes or limits liability where such limitation is not permitted by applicable law, including liability for fraud or for death or personal injury caused by negligence.
We may suspend or terminate your access to EmployNursing.com at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or illegal activity, or used the platform in a way that may harm other users, employers, or the integrity of the platform.
We may also take such action where required to comply with legal obligations or protect the security of the platform and its users.
You may stop using EmployNursing.com at any time. You may request deletion of your account or content by contacting us at support@employnursing.com. We will process such requests in accordance with applicable legal requirements and our Privacy Policy.
To comply with applicable data protection laws, including data minimization and storage limitation principles under the GDPR and UK GDPR where applicable, EmployNursing.com retains personal data only for as long as necessary for the purposes for which it was collected.
If an account is inactive for an extended period, we may notify you via your registered email address and request that you confirm whether you wish to keep your account active.
If you do not respond or log into your account after such notice, we may suspend or delete your account and associated personal data.
For the purposes of this section, “activity” may include actions such as logging in, updating your profile, submitting applications, or posting job listings.
If your account is deleted, you may lose access to your data, and we may not be able to restore it.
Where we remove content, restrict access to features, or suspend or terminate an account, we may, where appropriate and subject to applicable law, notify you of the reason for our decision.
Such notice may include general information about the nature of the issue (for example, violation of these Terms, fraudulent activity, or risk to platform integrity). We are not always required to provide detailed explanations or disclose internal review methods or security-related information.

We may update or modify these Terms from time to time. When we make material changes, we will provide notice by email, through the platform, or by posting a notice on EmployNursing.com.
The updated Terms will take effect on the date stated in the revised version. By continuing to access or use EmployNursing.com after the updated Terms become effective, you agree to be bound by the revised Terms.
If you do not agree to the updated Terms, you should stop using the platform.
These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.
Any disputes arising out of or relating to these Terms or your use of EmployNursing.com shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida, United States, and you agree to submit to the personal jurisdiction of such courts.
EmployNursing.com may offer employers the ability to pay to promote or boost their job listings for increased visibility on the platform.
Promoted listings are displayed more prominently than standard listings and are clearly labelled as “Promoted” or “Sponsored” to distinguish them from organic results.
Standard (non-promoted) listings are displayed based on relevance and/or reverse chronological order (most recent postings first), unless otherwise indicated by the platform.
We reserve the right to determine the placement, appearance, and format of promoted listings and advertising within the platform.
EmployNursing.com may display third-party advertisements, including advertisements served through Google Ads or similar advertising networks.
Advertisements are clearly labelled as “Ad” or “Sponsored” and are displayed separately from job listings and other organic platform content.
Where required by applicable law, advertising platforms may provide information identifying the advertiser responsible for a given advertisement.
For more information about why you are seeing a particular advertisement, you may use Google’s Ad Transparency tools or other equivalent tools provided by the relevant advertising network.
If EmployNursing.com qualifies as a hosting service or online platform under Regulation (EU) 2022/2065 (the “Digital Services Act” or “DSA”), the following provisions apply to users located in the European Union.
We provide a mechanism for users to notify us of illegal content on the platform. Reports can be submitted by contacting us at support@employnursing.com.
Where we become aware of content that is illegal or in violation of these Terms, we may remove or disable access to such content in accordance with applicable law.
Where required by law, we may provide users with information regarding moderation decisions, including the reasons for removal or restriction of content and available avenues for appeal.
Nothing in this section limits our rights to take action to protect the integrity, safety, or security of the platform or its users.
If you become aware of content on EmployNursing.com that you believe to be illegal under EU law or the law of any EU member state, you may submit a notice to us at:

We will acknowledge receipt of your notice, take action where appropriate, and inform you of our decision and the reasons for it.
If you disagree with a decision we have made in response to a notice of illegal content, or a decision to remove content or restrict your account, you may challenge it by contacting us at [contact email not configured], setting out the grounds for your challenge.
For transparency, Glacier Systems Pty Ltd — which operates the Job Boardly platform on which EmployNursing.com is built — has appointed DataRep as its EU legal representative under Article 13 of the DSA. DataRep can be contacted at digitalrequest@datarep.com (quote “Job Boardly” in the subject line), via the online webform at www.datarep.com/data-request, or by post at DataRep, The Cube, Monahan Road, Cork, T12 H1XY, Republic of Ireland.
If EmployNursing.com qualifies as a hosting service or online platform under the DSA and is established outside the EU, EmployNursing.com is responsible for designating its own EU legal representative under Article 13 of the DSA in respect of its own activities. The DataRep appointment described above applies only to Glacier Systems Pty Ltd’s role as platform provider.
